Project Terms & Conditions

All our yacht work is covered by the following Terms, Conditions, and Exclusions:

 

  • Errors and Omissions Excepted. Any prepared quotation has been compiled using the provided scope and information from the vessel and using our own experience and knowledge. Whilst we do not foresee any additional costs, should this occur, the client will be informed in writing at the soonest and a formal quotation for the additional service and/or materials will be provided. Additional work would not commence until written acceptance is received from the client.

 

  • All quotations are valid for 30 days – all prices quoted are exclusive of VAT/IVA/Tax. Projects can be invoiced in USD, GBP, EUR. Pricing is tied to GBP as the base currency – any exchange rate fluctuations greater than 3% will result in an adjustment being applied, when payment is made in an alternative currency.

 

  • We retain ownership title to all goods, materials and programming intellectual property until paid for in full.

 

  • All orders for products and materials are placed after receiving written acceptance and/or a purchase order from the client, alongside clearance of funds in our account.

 

  • Yard Fees, Shipping, Duty & Taxes excluded.

 

  • Travel and subsistence expenses including flights, accommodation, taxis, parking and car hire to be billed at cost plus 10%. Subsistence is billed at £50 per man, per day. Alternatively, the client is free to oversee travel and accommodation arrangements directly.

 

  • We have not allowed for additional access, e.g., working platforms scaffolding, cranage etc. if required these are to be free issue from owner/yard and in place before project start (if required).

 

  • Welding, cutting, carpentry, painting, insulation works, or fabrication of mounts/brackets excluded (additional quote can be provided)

 

  • Removal of deck heads excluded.

 

  • ⁠MCT cable transits opening or closing excluded (additional quote can be provided)

 

  • Waste Disposal, all old equipment removed and waste from new installation will be disposed of free issue in the yard facilities to be arranged by client.

 

  • Parking in the yard to be free issued and available.

 

  • ⁠Storage for removed equipment and new equipment to be located at shipyard and arranged by client. All equipment becomes the legal responsibility of the vessel from the point of delivery.

 

  • ⁠Any additional works over and above any items noted above will be charged at our nominal hourly rate of £100 per hour and invoiced on a weekly basis.

 

  • ⁠For any reason, the works are held up or delayed for whatever reasons or third parties, all hours will be charged at the nominal rate of £100 per hour. All standby time will be logged and signed for by the client.

 

  • ⁠If in the event of COVID19 or another reason the vessel is shut down, all hours for travel and standby are charged at the nominal rate of £100 per hour. Cost of any travel and/or testing resulting from a shut down are to be covered by the client. All Engineers have the right to refuse attending the vessel if there are any issues that could cause harm or infection to them or others around them. It is also their right to request repatriation during any or all virus-related incidents.

 

  • Installation Warranty – our installations are provided with a 12-month time onboard warranty. This warranty excludes travel, accommodation, subsistence and related expenses, to the vessel, which would be chargeable at cost plus 10%.

 

  • Hardware Warranty – Hardware is provided with manufacturer’s warranty, information provided on as supplied basis. Hardware failure is not covered by our Installation Warranty and would be chargeable separately.

 

  • ⁠Any work undertaken on an ad hoc basis (Day Work) is charged at £100 per hour and is subject to the general applicable terms and jurisdiction of this document.

 

  • ⁠Governing law and Jurisdiction. All associated works and the contents of any agreement, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this document or its subject matter or formation, shall be governed by, and construed in accordance with, the laws of England. Each Party irrevocably agrees that the courts of England shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this project, document or its subject matter, formation or implementation.
